On November 29th, 2007 Call Rich Inc. DBA Cnywireless

Made a cash purchase for All of Cny Communications wireless equipment and customer list.

The agreement was based on a "Good-Faith" customer list (w/o address' or Identities) provided to Call Rich Inc. pre-purchase. 

The list included current income and contract expiration dates of Cny Communications customers.

Joe Crestuk, The President of Cny Communications assured Rich Hatherill, owner of Call Rich Inc. that all customers on the list would be able to be serviced from Call Rich's main tower location.  He further stated that no customers would need a "dedicated ip address".

Both of these claims were less than true!

Cny Communications insisted on a cash only purchase and would not accept any kind of Cashiers Check or Money Order.

 

The paid for customer list has the following anomalies:

  • 40% of the customers will never be able to be serviced from Call Rich's Main Tower because of their location.

  • 1 customer requires 4 dedicated ip address' alone.

  • 1 customer requires 1 dedicated ip address.

  • 1 customer who has been contacted and notified has not used the service for over 1 year but had still been paying the bill.

  • 1 customer stopped using Cny Communications in October 2007.

  • 1 customer stopped using Cny Communications in 2006.

As a result of this fraudulent customer list, Call Rich is only able to service < 30% of the customers on the list!

Call Rich Inc. considers this contract based on a fraudulent customer list to be null and void.

Call Rich Inc. has moved the remaining "Valid" customers to it's network.
